Terms of Service

1. Introduction

Welcome to AccuLearnPH. These Terms of Service ("Terms") govern your use of the AccuLearnPH website, platform, and services (collectively, the "Services"), so please read them carefully before using the Services.

By accessing or using our Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access or use our Services.

2. Use of Services

2.1 Eligibility

To use our Services, you must be at least 18 years old and capable of forming a binding contract with AccuLearnPH. By using our Services, you represent and warrant that you meet these requirements.

2.2 Account Registration

To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

2.3 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Services in any way that violates any applicable law or regulation
  • Use the Services to transmit or facilitate the transmission of unsolicited or unauthorized advertising or promotional material
  • Impersonate or attempt to impersonate AccuLearnPH, an AccuLearnPH employee, another user, or any other person or entity
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Services or any server, computer, or database connected to the Services
  • Use any robot, spider, or other automatic device, process, or means to access the Services for any purpose, including monitoring or copying any of the material on the Services

3. Course Enrollment and Payment

3.1 Course Enrollment

By enrolling in a course, you agree to pay all applicable fees for the course as listed on our website at the time of enrollment. Enrollment in a course is subject to availability and acceptance by AccuLearnPH.

3.2 Payment Terms

Payment for courses must be made in full at the time of enrollment unless an installment plan is explicitly offered and selected. All payments are to be made in Philippine Pesos (PHP) through the payment methods available on our website.

If you choose an installment plan, you agree to make payments according to the schedule provided. Failure to make timely payments may result in suspension or termination of your access to course materials and activities.

3.3 Refunds

Refund requests must be made within 7 days of enrollment and before accessing more than 20% of the course content. Refunds are subject to a 10% administrative fee. No refunds will be provided after this period or if you have accessed more than 20% of the course content.

In case of exceptional circumstances (e.g., medical emergencies), refund requests may be considered on a case-by-case basis and will require appropriate documentation.

3.4 Course Changes and Cancellations

AccuLearnPH reserves the right to modify course content, schedules, or instructors at its discretion. We will make reasonable efforts to notify enrolled students of any significant changes.

If AccuLearnPH cancels a course, enrolled students will be offered the option of a full refund or transfer to a comparable course.

4. Intellectual Property

4.1 Course Materials

All course materials, including but not limited to videos, presentations, documents, and assessments, are the intellectual property of AccuLearnPH or its licensors and are protected by copyright and other intellectual property laws.

Upon enrollment and payment, you are granted a limited, non-exclusive, non-transferable license to access and use the course materials for your personal, non-commercial educational purposes only.

4.2 Restrictions

You may not:

  • Copy, reproduce, distribute, publicly display, or create derivative works of the course materials
  • Share your account credentials or course access with any third party
  • Record, download, or otherwise capture video content from the courses unless explicitly permitted
  • Use the course materials for any commercial purpose
  • Remove any copyright or other proprietary notices from the course materials

5. User Content

Our Services may allow you to post, submit, or share content, such as forum posts, assignments, or feedback ("User Content"). By providing User Content, you grant AccuLearnPH a non-exclusive, royalty-free, worldwide, perpetual, and irrevocable right to use, copy, modify, distribute, and display the User Content in connection with our Services.

You represent and warrant that your User Content does not infringe any third-party rights and that you have all necessary rights to grant the license above.

6. Limitation of Liability

To the fullest extent permitted by law, AccuLearnPH and its directors, employees, partners, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services, including but not limited to loss of revenue, income, profits, data, or goodwill.

In no event shall the aggregate liability of AccuLearnPH for all claims related to the Services exceed the total amount paid by you to AccuLearnPH for the course or service that is the subject of the claim.

7. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. AccuLearnPH disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

AccuLearnPH does not warrant that the Services will be uninterrupted, error-free, or secure, or that any defects will be corrected.

8. Termination

AccuLearnPH reserves the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Metro Manila, Philippines.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. The most current version of these Terms will be posted on our website with the "Last Updated" date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
